DISTANCE SALES AGREEMENT

1. PARTIES

This Distance Sales Agreement is concluded electronically between the SELLER and the BUYER identified below, subject to the following terms and conditions.

By confirming an order that creates an obligation to pay, the BUYER acknowledges the obligation to pay the product price, shipping charges and any other additional charges disclosed before the order was placed.

2. DEFINITIONS

For the purposes of this Agreement:

Ministry means the Ministry of Trade of the Republic of Türkiye.
Law means Turkish Law No. 6502 on the Protection of Consumers.
Regulation means the Turkish Regulation on Distance Contracts.
Website means the SELLER’s website at hueatelier.shop and any relevant subdomains through which the order is placed.
Agreement means this Distance Sales Agreement between the SELLER and the BUYER.
BUYER means a consumer purchasing products through the Website for purposes outside their trade or profession.
Goods / Products means the movable goods offered for sale on the Website, including porcelain products.
Durable Medium means a means, such as email, that allows the BUYER to store information addressed to them and access it later without alteration.

3. SUBJECT MATTER

This Agreement governs the sale and delivery of products ordered electronically by the BUYER through the Website, together with the parties’ rights and obligations. The products’ main characteristics and prices are stated on the product page, in the Pre-Contract Information Form and in the order summary.

The Pre-Contract Information Form and the product, price, payment and delivery details for the order form an integral part of this Agreement. The right of withdrawal and its exceptions are set out in Sections 10 and 11.

Prices displayed on the Website remain valid until updated. Price changes made after an order has been confirmed do not change the price of that order.

7. PRODUCTS AND PRICE

7.1. The product type, material, color, dimensions, quantity and any personalization are stated on the product page and in the order summary.

7.2. The product price, including taxes collected by the SELLER, discounts, shipping charges, any other additional charges, the total payable amount and the payment currency are displayed before the order is confirmed.

7.3. For international orders, whether import taxes and customs charges are included in the price, and who is responsible for them, is disclosed before the order is placed. This Agreement does not automatically make the BUYER responsible for an additional charge that was not disclosed beforehand.

The invoice is provided electronically or in paper form in accordance with applicable law.

9. GENERAL TERMS

9.1. Pre-Contract Information: Before the order is placed, the SELLER provides the products’ main characteristics, the SELLER’s identity and contact details, the total price, payment and delivery terms, the right of withdrawal and any applicable exceptions. The BUYER reviews this information before confirming the order. This Agreement and the pre-contract information are provided on a Durable Medium so that the BUYER can retain them.

9.2. Preparation, Dispatch and Delivery: The times disclosed on the product page and during ordering apply. Unless otherwise stated, the following preparation times apply after payment confirmation:

In-stock products ready for shipment: Dispatched within 3 business days.
Standard designs made to order: Dispatched within 10–14 calendar days.
Products personalized or custom-designed for the BUYER: Dispatched after a production period of 2–3 weeks.

These are dispatch times, not final delivery times. Estimated transit times are disclosed separately before the order is placed. For orders subject to Turkish distance selling law, delivery must take place within 30 days of the SELLER receiving the order, except for products made to the BUYER’s specifications or personal requirements.

Making a product to order does not, by itself, make it personalized or remove the right of withdrawal.

9.3. Carriers: International orders may be shipped through ShipEntegra and its partner carriers. Available domestic and international shipping options and charges are displayed during ordering. Use of ShipEntegra as a shipping platform does not, by itself, designate a return carrier.

9.4. Delivery Responsibility: The SELLER must deliver the products intact, complete and in accordance with the order specifications. When a carrier offered by the SELLER is used, the SELLER remains responsible for loss or damage until delivery to the BUYER or to a third party designated by the BUYER, other than the carrier. Where the BUYER independently selects a carrier not offered by the SELLER, applicable law governs responsibility.

9.5. Delays and Inability to Fulfil: If circumstances such as a natural disaster, logistics disruption or customs processing prevent the stated time from being met, the SELLER informs the BUYER without delay, provides a revised time where possible, and offers the option to expressly accept the delay or cancel the order for products not yet shipped and receive a refund. If the required consent to the delay is not obtained, the order is cancelled as required by applicable law and payments are refunded within the applicable statutory time limits. A delay notice does not remove the BUYER’s statutory cancellation or refund rights.

For orders subject to Turkish distance selling law, if fulfilment becomes impossible, the SELLER informs the BUYER in writing or on a Durable Medium within 3 days of becoming aware of the situation and refunds the payments collected, including delivery charges, within 14 days of that notification. A product being out of stock does not, by itself, constitute impossibility. If applicable law requires a shorter refund period, that period applies.

9.6. Handmade Characteristics: Products are made by hand and individually glazed, so variations in color, glaze flow, dimensions, shape and small surface details may occur. Reasonable handmade variations described on the product page contribute to each piece’s character. This explanation does not limit the BUYER’s rights concerning defective goods, including breakage, unsafe use or failure to meet the product’s stated essential characteristics.

9.7. Inspection on Delivery: The BUYER is encouraged to inspect the package and product on delivery and, where damage, crushing or breakage is suspected, take photographs and obtain a carrier damage report where possible. The absence of photographs or a carrier report does not, by itself, prevent the BUYER from exercising statutory rights.

9.8. Communications: Marketing messages by SMS or email are sent on the basis of any required separate consent. Transactional messages, such as order confirmations, payment information and shipping updates, do not depend on marketing consent. Information about the processing of personal data is provided in the Website’s privacy and personal data protection notices.

10. RIGHT OF WITHDRAWAL

10.1. Period: Subject to the exceptions in Section 11, the BUYER may withdraw from the Agreement within 14 days of the date on which the BUYER, or a third party designated by the BUYER other than the carrier, receives the product, without giving a reason or paying a penalty. The right of withdrawal may also be exercised before delivery. For products from a single order delivered separately, the period starts when the last product is received.

10.2. Notice: A clear withdrawal notice sent to the SELLER in writing or on a Durable Medium, such as email, before the period expires is sufficient. No particular form or prior approval from the SELLER is required.

Including the order number, the BUYER’s name and the products being returned helps the SELLER process the notice.

10.3. Sending the Product Back: Unless the SELLER offers to collect the product, the BUYER sends it back to the SELLER or a person authorized by the SELLER within 14 days of sending the withdrawal notice. The return address and designated carrier are stated in Section 4 and in the pre-contract information. Suitable protective packaging must be used to help prevent damage during transit. The absence of the original packaging does not, by itself, remove the right of withdrawal.

10.4. Use: Where Turkish distance selling law applies, the BUYER is not responsible for changes or deterioration resulting from use of the product during the withdrawal period in accordance with its functioning, technical specifications and instructions for use. Other circumstances are assessed under applicable law.

10.5. Return Shipping Charges: The BUYER is not charged return shipping costs for withdrawal returns made using the carrier designated in the pre-contract information. If no carrier was designated in that information, no return costs are charged to the BUYER. If the designated carrier has no branch at the BUYER’s location, the SELLER arranges collection without any additional charge. If the BUYER wishes to use a different carrier, the shipping arrangements and any cost information are disclosed before dispatch; statutory rights remain unaffected.

10.6. Refunds: Under Turkish distance selling law, for withdrawal returns of delivered products, the SELLER refunds the payments due, including delivery charges collected, within 14 days of the product being handed to the designated return carrier. If a different carrier is used, the period starts when the SELLER receives the product. Where withdrawal is exercised before delivery, the refund is made within 14 days of the SELLER receiving the withdrawal notice.

Refunds are made in a single payment using a method consistent with the original means of payment, without imposing any cost or obligation on the BUYER. If applicable mandatory law requires a shorter period or provides broader rights, that law applies.

11. EXCEPTION TO THE RIGHT OF WITHDRAWAL

Under the Regulation, unless otherwise agreed, the right of withdrawal does not apply to products made to the BUYER’s specifications or personal requirements. This may include, for example, products bearing a name or text added specifically for the BUYER, or products made in a special size or design outside the standard options at the BUYER’s request.

Producing a standard design after an order is placed, making a product by hand or not holding it in stock does not, by itself, justify this exception. Any applicable withdrawal exception is clearly disclosed before the order is placed.

The absence of a right of withdrawal does not remove the BUYER’s statutory rights concerning defective, damaged or incorrect products. Mandatory local rules applicable to consumers outside Türkiye remain unaffected.

12. DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS

12.1. If a product arrives damaged, defective, incomplete or incorrect, the BUYER may contact the SELLER at atolyehue@gmail.com. The order number and photographs, where available, help resolve the issue. Reporting the issue as soon as reasonably possible is encouraged; this recommendation does not shorten statutory claim periods or create an additional deadline that results in loss of rights.

12.2. Surface variations that may occur in handmade products are assessed differently from cracking, leaking or issues affecting safe use. If an issue, including glaze cracking, affects the product’s stated use or safety, the BUYER should stop using it and contact the SELLER. Explanations about handmade production do not remove liability for defective goods.

12.3. The BUYER retains all rights available under applicable law, including cancellation and refund, a price reduction, repair free of charge or replacement with a conforming product where available. Costs relating to the return and resolution of defective goods are handled in accordance with applicable law.

13. DISPUTES AND COMPETENT AUTHORITIES

For disputes subject to Turkish consumer law, the BUYER may apply to Consumer Arbitration Committees or Consumer Courts in accordance with the financial thresholds and jurisdiction rules in force at the time of the application. Where legally required, mediation must be sought before a claim is filed with a Consumer Court.

Consumers residing outside Türkiye retain their rights under applicable mandatory consumer protection laws in their own countries, including available remedies and access to competent authorities. This Agreement must not be interpreted as limiting applicable mandatory consumer rights or avenues for redress.

14. EFFECTIVE DATE

This Agreement takes effect when the BUYER electronically accepts the pre-contract information and this Agreement and confirms an order creating an obligation to pay. The order details are provided together with the Agreement in a form the BUYER can retain.

If any provision conflicts with applicable mandatory law, the mandatory rule prevails. This does not affect the remaining valid provisions.
